DA5 is a mobile lifestyle application designed to address and enrich our customers' day-to-day needs and wants. It aims to provide a convenient, automated, and secure mobile payment facility for registered sellers and service providers, all in a one-stop shop.
At DA5, we recognize the importance of data privacy and commit to protecting the confidentiality of all personal information of our clients. In line with this, we ensure that we comply with the requirements of the Data Privacy Act of 2012 (RA 10173), along with its Implementing Rules and Regulations as well as any other relevant data privacy-related laws and issuances by the National Privacy Commission. Furthermore, we only collect and process information that is necessary to fulfill the purpose of our platform.
In accordance with this, this privacy policy will detail any necessary information about how DA5 will collect, process, and store your personal data. This includes how long we will retain the information, all your privacy rights in relation to that data, and the people/organizations with whom we may share it, when necessary.
The content of this Privacy Statement may be updated or amended from time to time to align with any future platform configurations, and to comply with any changes in relevant laws and policies. Should these changes require your consent, we will be sure to notify you and request your said updated consent as you proceed with using the platform. Otherwise, changes will be rendered effective immediately upon posting.

Personal Information refers to any information, whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information or when put together with other information would directly and certainly identify an individual;
Data Subject / User – refers to an individual whose Personal, Sensitive, or Privileged information is processed;
Consent of the Data Subject refers to any freely given, specific, informed indication of will, whereby the Data Subject agrees to the processing of his or her personal, sensitive personal, or privileged information. It may also be given on behalf of a Data Subject by a lawful representative or an agent specifically authorized by the Data Subject to do so;
Processing refers to any operation or set of operations performed upon Personal Data including, but not limited to, the collection, recording, organization, storage, updating or modification, retrieval, consultation, use, consolidation, blocking erasure, or destruction of data. Processing may be performed through automated means, or manual processing, if the Personal Information is contained or is intended to be contained in a filing system;
Outsourcing refers to the disclosure or transfer of personal data by the DA5 Tech Team to Personal Information Processor/s (PIP/s), if any, for the Processing of Personal Information obtained or shared under this Agreement;
Personal Data Breach refers to a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, Personal Information transmitted, stored, or otherwise processed.
Cookies Are small digital signature files that are stored by your web browser that allow your preferences to be recorded when visiting the website. Also they may be used to track your return visits to the website. Like many sites, we use “cookies” to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Site.
Storage Information Specifically in the Surge App, the storage is Da5’s’ cloud facility which can be accessed by Surge App when necessary. The information gathered will be accessed sparingly by the Sites.
Security. The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security. To further the safeguard of the information we will gather we will comply to Sec. 20 of Republic Act 10173, which gave protection to your personal information.

As a user of DA5, you are entitled to the following data privacy rights, as articulated in the Data Privacy Act of 2012:
No personal information from data subjects will be collected until the user has given their consent for its collection. In order to register and create an account under DA5, we only require the user to submit their mobile number. Once the account has been created and if the user would like further access to various functions in the app, other information will be required to validate the identity of the registered user. In any instance wherein personal data is requested for a specific reason that is not covered in this privacy policy, we will state why we need such information, as well as the legitimate purpose for collecting it. Correspondingly, if there is an instance that we will process your data for any purpose other than for which it was originally collected, we shall provide a clear explanation and description of said purpose, along with any other relevant information pertinent to the processing.
We may use your personal information for various purposes, including the following, and any other future purpose not mentioned herein shall be disclosed:
Surge App and DA5 have the rights to terminate, whenever necessary, such users that are suspected to have fraudulent actions or the incorrect inputted information to the application. Users are responsible for the fair use of the application. Such actions like fraud, theft, and the like are highly prohibited in the system. Users who engage in these will be subject to account termination.
We implement reasonable and appropriate physical, technical, and organizational measures to prevent the loss, destruction, misuse, or alteration of your information. We keep and protect your information using a secured server behind a firewall, encryption, and security controls to ensure our clients are committed to protecting their information from personal data breaches.
DA5 shall retain the data provided by the user for a period of five (5) years per Bangko Sentral ng Pilipinas (BSP) regulations. Users also have the option of requesting their data to be deleted at any given time by requesting deletion of data functions within the application, or by contacting us directly. When we no longer require your data, DA5 Tech Team shall securely delete said information.
